1. Agreement Overview
These Affiliate Program Terms and Conditions ("Agreement") constitute a legally binding agreement between The WebSmith Group ("Company," "we," "us," or "our"), the publisher of The First Horseman: Donald Trump and Biblical Prophecy, and you ("Affiliate," "you," or "your") upon your acceptance into the affiliate program.
By completing the affiliate registration form, clicking the acceptance checkbox, or promoting any Company products using an affiliate link, you acknowledge that you have read, understood, and agreed to be bound by this Agreement in its entirety.
2. Eligibility
To participate in the affiliate program you must:
Be at least 18 years of age.
Have a valid email address and an active online presence (website, social media, email list, podcast, or similar platform).
Agree to comply with all applicable laws, including but not limited to FTC endorsement guidelines and CAN-SPAM regulations.
Not be a resident of a jurisdiction where participation in affiliate programs is prohibited by law.
The Company reserves the right to approve or deny any affiliate application at its sole discretion and to terminate any affiliate relationship at any time.
3. Eligible Products and Commission Structure
Affiliates earn a 30% commission on net sales of the following digital products:
Digital Edition (Flipbook) | Commission: 30% of purchase price
Audiobook | Commission: 30% of purchase price
Bundle (Digital + Audiobook) | Commission: 30% of purchase price
IMPORTANT: Commissions are not paid on physical printed editions of the book, including the paperback edition sold through Books.by or the hardcover edition sold through Amazon KDP. These products are fulfilled by third-party retailers and fall outside the scope of this affiliate program.
Commission rates are subject to change with 30 days written notice to active affiliates.
4. Affiliate Links and Tracking
Upon acceptance into the program, you will receive a unique affiliate link through our affiliate management system. This link tracks purchases attributed to your referrals.
The tracking cookie window is [X] days from the date of the initial click. If a customer purchases within that window after clicking your link, the sale is attributed to you.
You are responsible for using only your assigned affiliate link. You may not manipulate, alter, or attempt to circumvent the tracking system.
The Company is not responsible for lost commissions resulting from a customer clearing cookies, using a different browser or device, or purchasing through a different link.
5. Commission Payment
Commissions are paid on a [monthly / bi-weekly] basis for all confirmed sales from the prior period.
A minimum balance of $[XX] must be reached before payment is issued. Balances below the threshold carry forward to the next payment period.
Payments are issued via [PayPal / bank transfer / check] to the payment information provided in your affiliate profile. You are responsible for keeping your payment information current and accurate.
Commissions are subject to a [X]-day hold period to account for refunds and chargebacks. Commissions on refunded orders will be reversed.
You are solely responsible for reporting affiliate income to the appropriate tax authorities. The Company will issue a Form 1099 to U.S.-based affiliates who earn $600 or more in a calendar year.
6. Permitted Promotional Methods
Affiliates may promote Company products through the following channels:
Personal websites, blogs, and online publications.
Social media accounts (Facebook, Instagram, X, YouTube, TikTok, LinkedIn, and similar platforms).
Email newsletters and lists to which recipients have opted in voluntarily.
Podcasts and video content.
Paid advertising, subject to the restrictions in Section 7.
7. Prohibited Promotion Methods
The following promotional methods are strictly prohibited and may result in immediate termination and forfeiture of unpaid commissions:
Spam. You may not send unsolicited commercial email or messages of any kind to promote affiliate links.
Misleading claims. You may not make false or misleading statements about the book, its contents, the author, or the Company.
Paid search advertising using the brand terms "The First Horseman," "Kelly Smith," or "first-horseman.com" without prior written approval from the Company.
Cookie stuffing or any other method of artificially generating clicks or impressions.
Impersonating the author or the Company in any communication.
Promoting through hate-based, discriminatory, or illegal content platforms or channels.
Offering unauthorized discounts, coupons, or incentives not approved in writing by the Company.
8. FTC Disclosure Requirement
Federal Trade Commission guidelines require that affiliates clearly disclose their financial relationship with the Company whenever promoting Company products. This is not optional.
You must include a clear and conspicuous disclosure in any content where your affiliate link appears. Acceptable examples include:
"This post contains affiliate links. I earn a commission if you purchase through my link, at no additional cost to you."
"Affiliate link below. I receive a commission on purchases made through this link."
The disclosure must appear before the affiliate link, not buried in a footer or at the end of lengthy content. You are solely responsible for ensuring your disclosures comply with current FTC guidelines and any applicable laws in your jurisdiction.
9. Content Standards
All promotional content must accurately represent the book and its subject matter. The book is a work of personal scripture study and prophetic analysis. It is not presented as official doctrine of any church.
You may not present the book as predicting specific future events with certainty, as endorsed by any political organization or campaign, or as official teaching of The Church of Jesus Christ of Latter-day Saints or any other religious organization.
The Company reserves the right to request removal of any affiliate content it deems misrepresentative or damaging to the book's reputation. Failure to comply with a removal request within 48 hours constitutes grounds for termination.
10. Intellectual Property
The Company grants you a limited, non-exclusive, non-transferable license to use approved marketing materials, including book cover images, provided descriptions, and promotional copy, solely for the purpose of promoting Company products through this affiliate program.
You may not modify, alter, or create derivative works from Company intellectual property without written approval. You may not use the author's name, likeness, or voice in any way that implies personal endorsement beyond what is provided in approved affiliate materials.
11. Termination
Either party may terminate this Agreement at any time with written notice. The Company may terminate immediately and without notice for violations of Sections 7, 8, or 9 of this Agreement.
Upon termination, your affiliate link will be deactivated. Commissions earned on confirmed, non-refunded sales prior to termination will be paid at the next scheduled payment date, provided the minimum threshold is met. Commissions forfeited for cause will not be paid.
12. Limitation of Liability
The Company's liability to any affiliate under this Agreement shall not exceed the total commissions paid to that affiliate in the three months preceding any claim. The Company is not liable for indirect, incidental, or consequential damages of any kind.
The Company makes no guarantee of earnings. Affiliate income depends entirely on the affiliate's own promotional efforts, audience, and market conditions.
13. Modifications to This Agreement
The Company reserves the right to modify these terms at any time. Affiliates will be notified of material changes by email at least 30 days before the changes take effect. Continued use of your affiliate link after the effective date of any modification constitutes acceptance of the updated terms.
14. Governing Law
This Agreement shall be governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved in the courts of Washoe County, Nevada.
15. Entire Agreement
This Agreement constitutes the entire agreement between the Company and the Affiliate with respect to the affiliate program and supersedes all prior communications, representations, or agreements on the subject.
